Terms and conditions of sale

1. Purpose and scope
These terms and conditions of sale (the "Terms") govern all sales concluded on the Galaxy Sphere online shop, available at https://galaxy-sphere.com (the "Site"), between MENDING and any consumer customer (the "Customer"). Any order placed on the Site implies unreserved acceptance of these Terms.

3. Products
The products sold are decorative objects: glass spheres containing a celestial motif engraved in 3D inside, delivered with a wooden base fitted with an LED powered by a USB cable. The essential characteristics (dimensions, material, parcel contents) are stated on each product page. Photographs illustrate the products as faithfully as possible; minor variations in tone may occur depending on the screen.
These objects are not toys. They contain glass and must be kept out of the reach of young children.
4. Prices
Prices are stated in euros, all taxes included, with French VAT at the applicable rate. They do not include any delivery charges, which are stated before the order is finally confirmed. MENDING reserves the right to change its prices at any time; products are invoiced at the rates in force when the order is confirmed. An invoice is issued for every order.
5. Orders
Orders are placed on the Site: products are added to the cart, the summary is checked, delivery details are entered, then payment is made. The sale is deemed concluded upon payment confirmation. MENDING confirms the order by email. MENDING reserves the right to refuse any abnormal order or any order placed in bad faith.
6. Payment
Payment is made online, in full, using the methods offered at checkout (payment is processed by the secure provider of the Shopify platform). Orders are dispatched only once payment has actually been received.
7. Delivery
Products are delivered to the address given by the Customer when ordering. Indicative delivery times are stated when ordering; as some products are dispatched from warehouses located outside the European Union, times may extend to several weeks. In accordance with article L.216-1 of the French Consumer Code, delivery takes place no later than thirty (30) days after the contract is concluded, unless otherwise agreed. Failing that, the Customer may terminate the contract after unsuccessfully requiring MENDING to deliver within a reasonable additional period.
Delivery is free, with no minimum order.
It is for the Customer to check the condition of the parcel on delivery and to report any damage or missing item as soon as possible.
8. Right of withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to give reasons. The Customer notifies MENDING by any means expressing their wish to withdraw: using the online withdrawal form, or by email to the address stated in article 2.
The Customer returns the complete product, in its original packaging, no later than fourteen (14) days after notifying their withdrawal. Return costs are borne by the Customer. MENDING refunds all sums paid, including the initial delivery charges (at the standard rate), no later than fourteen (14) days from recovery of the product or proof of its dispatch.
A product that arrives broken or faulty falls not under withdrawal but under the legal guarantee of conformity (article 9): in that case no return is requested and costs are borne by MENDING. See report a broken or faulty product.
The Customer may be held liable for any depreciation of the product resulting from handling other than what is necessary to establish its nature and characteristics.
9. Legal guarantees
Independently of any commercial warranty, the Customer benefits from:
the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code): for two (2) years from delivery, the Customer may obtain repair or replacement of a non-conforming product, or failing that a price reduction or termination of the sale;
the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code): the Customer may choose between termination of the sale or a price reduction.

9 bis. Take-back of used electrical equipment (WEEE)
The illuminated base sold with the spheres is electrical and electronic equipment. In accordance with articles L.541-10-8 and R.543-180 of the French Environment Code, MENDING takes back free of charge used equipment of the same type as that sold, one appliance taken back per appliance sold. In distance selling, this take-back happens at the delivery address.
To benefit from it, the Customer makes the request before or when ordering, specifying the appliance to be taken back. The Customer may also drop used equipment off free of charge at a recycling centre or at the collection points provided for that purpose. Electrical equipment must not be discarded with household waste.
10. Liability
MENDING cannot be held liable for damage resulting from abnormal use of the product or from failure to observe the precautions of use (glass object, presence of a low-voltage electrical component). MENDING cannot be held liable for non-performance due to force majeure.
11. Personal data
The data collected when ordering is necessary to process the order (order management, delivery, invoicing). It is processed in accordance with the GDPR and the French Data Protection Act. The Customer has rights of access, rectification, erasure and objection, which may be exercised using the details in article 2. See also the legal notice.
12. Consumer mediation
In accordance with article L.612-1 of the French Consumer Code, the Customer may use a consumer mediator free of charge to settle any dispute amicably. Appointed mediator: CM2C, 49 rue de Ponthieu, 75008 Paris, www.cm2c.net. The Customer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
13. Governing law
These Terms are governed by French law, without depriving the consumer Customer of the protection afforded by the mandatory provisions of the law of their country of residence. In the event of a dispute and failing an amicable settlement, the competent courts will be determined under ordinary rules of law.
